The real problem is neither EPA or OSHA should prosecute charges of violation internally. Each and every case should go before a federal court and a jury. Allowing internal prosecution is putting the fox in charge of the hen house! And doing so completely disregards a persons right to a jury of their peers be the ones finding them guilty.
