Talks Ongoing in Building Envelope Suit

Settlement negotiations continue in a trademark infringement lawsuit filed in May that pits a leading supplier of walls, windows and other building-envelope products against a magazine publisher.
BNP Media, publisher of the magazine Building Envelope and buildingenvelopeonline.com, has filed a motion for a third deadline extension to respond to a lawsuit filed by Oldcastle BuildingEnvelope Inc., according to USGlass News Network.
OldCastle BuildingEnvelope of Dallas, has accused BNP Media II LLC, of Troy, MI, of creating and using a copycat version of OldCastle's trade name.

The lawsuit was filed May 22 in U.S. District Court for the Northern District of Texas. Originally, BNP had until June 16 to respond to the complaint, but it was granted a 30-day extension.
A second extension was also granted when BNP expressed that the companies’ settlement talks were progressing, USGlass reports.
Third Extension Request
In its third request for a deadline extension, BNP notes that the parties have been engaged in ongoing settlement negotiations to resolve the case outside of court.
“These talks have continued to progress but it has become clear they cannot be concluded under the current extension,” USGlass reports, citing court documents.
The company has asked the court to move its deadline to respond to Sept. 16.
