Paint Store Manager Admits $168K Theft

A former Diamond Vogel paint store manager will serve up to four years in prison for siphoning off $168,000 from the operation he managed for 13 years.

Gerald S. Shearman, 47, of Omaha, NE, was sentenced to two to four years in prison, the Omaha World-Herald reported Feb. 9.

Gerald S. Shearman, a former Diamond Vogel paint store manager, stole $168,000 from the company over several years, the report said.

Shearman stole the money from the Diamond Vogel Service Center over the period of several years in order to pay off personal debts, according to the report.

U.S. Bankruptcy Court records show that Shearman was involved in personal bankruptcy proceedings in February 2011.

'You Knew Better'

Douglas County District Judge Peter Bataillon reportedly rejected an option for probation in sentencing Shearman, even though the judge said he did not think Shearman would repeat his crime.

“Problem is, you knew better," Bataillon told Shearman, according to the news bureau. "It lasted a considerable period of time. And it would depreciate the seriousness of the offense if I gave you probation.”

A spokesman for Diamond Vogel declined to comment on the case, and the County Attorney’s office did not return requests for more information.

Manager: ‘Hard to Get Out’

“It was hard for me to get out of it,” Shearman told the sentencing judge, according to the report. “I was afraid I was going to get caught, and I was trying to get all my bills caught up.”

Diamond Vogel is an Orange City, IA-based manufacturer of paints and coatings for architectural, heavy-duty protective, industrial, traffic and powder coating markets.

The company operates 66 Diamond Vogel Service Centers in 12 states.
