Des Moines Ordered to Pay Contractor $1M

A bridge-construction firm has won a yearslong court battle with the City of Des Moines, Iowa, stemming from the company’s three-year suspension from city contracts after a 2013 project that faced major delays.

Jenco Construction sued Des Moines in 2015 after the firm was blacklisted by the city, banned from bidding on contracts for three years. According to the Des Moines Register, the Saylorville, Iowa-based company was the lead contractor on the Grand Avenue Bridge reconstruction in 2013, which wrapped up about two months after it was scheduled to.

Delays in the rehabilitation of the Grand Avenue Bridge over Walnut Creek in 2013 led the City of Des Moines to suspend Jenco Construction from bidding on city projects; Jenco sued and has been awarded $1 million in damages.

The city banned Jenco from new city contracts based on what it characterized as a failure to deliver the project in a timely manner, but Jenco sued, arguing that below-grade issues, asbestos and an archeological dig were to blame for the setbacks, and the firm was not responsible for these issues as they came up after the start of the project.

While the suspension had already expired by the time the verdict was delivered May 9, the city was ordered to pay $1 million in damages to the contractor, according to the Associated Press.

The $3.3 million rehab project that spurred the ban and the suit was on the Grand Avenue Bridge over Walnut Creek, near the city’s border with West Des Moines. That Grand Avenue Bridge is about four miles from the larger Grand Avenue Bridge over the Des Moines River, which was replaced last year as part of a $10 million project.

Des Moines is in the process of rebuilding and replacing six major bridges over the Des Moines River.
