PA Man Charged in False Snooper Certification

A Pennsylvania man has been charged after allegedly falsely certifying bridge inspection vehicles, along with one count of making a false statement.

Kenneth Mix, 59, of Edensburg, Pennsylvania, was indicted in the U.S. District Court in Hartford, Connecticut. These charges stem from Mix’s alleged role in creating false Certificates of Unit Test/Examination of Material Handling Device for Under Bridge Inspection vehicles.

Falsifying Certification

As noted in the indictment, UBI vehicles have a movable boom with a platform. While an inspection is underway, the vehicles are positioned on top of a bridge. The boom lifts the inspectors alongside or beneath a bridge deck.

Mix served as supervisor for an undisclosed company that rents or leases equipment, including UBI vehicles, to engineering companies as well as government agencies for bridge projects. The firm is named in the indictment only as "Company A."

From January 2012 through January 2015, Mix allegedly helped create false or fictitious certificates for the UBI vehicles in the company's fleet. These certificates signified that the UBI vehicles had been examined according to federal standards, but Mix knew no examinations had been conducted.

The American National Standard Institute, Standard 92.8 indicates that UBI vehicles must have an annual inspection, including performance tests of all boom movements. The signature of the person responsible for the inspection is also required, as well as a description of any deficiencies found and corrective measures taken.

If convicted, Mix faces a fine of up to $250,000 and a maximum term of five years in prison.
