Builder Fined in Subcontractor’s Death

An Ontario court has fined a general contractor $100,000 in a concrete wall collapse that killed one subcontractor’s employee and seriously injured another nearly three years ago.

English Prestige Builders Ltd., based in Brampton, ON, pleaded guilty to two counts of failing as a constructor to protect the health and safety of workers on the site, violations under the Occupational Health and Safety Act, according to a Jan. 28 announcement on the case.

The Ministry of Labour brought the charges against English Prestige Builders after an investigation of the events on Oct. 28, 2011. Documents in the case were not immediately available for review.

The company did not respond Tuesday (Feb. 4) to a request for comment on the case.

The Deadly Incident

On the day of the incident, four workers employed by a subcontractor were working on a demolition project at Cosmos Furniture Ltd. in Brampton, according to authorities.

The subcontractor—Immaculate Scrap Metal Disposal—had been hired by English Prestige Builders to undertake the demolition of an interior concrete block wall at the furniture supplier's store.

The wall, which was about 26 feet high, collapsed on two of the workers. The demolition and wall collapse were recorded on surveillance video, according to authorities.

One worker suffered fatal injuries in the collapse. The other worker suffered severe injuries to the back, chest and pelvis. The identities of the victims were not released.

The Ontario Ministry of Labour investigates workplace injuries and deaths. The inspectors will take enforcement action, as appropriate, in response to any violation of provincial occupational health and safety rules.

The Ministry of Labour said it had found that the wall had collapsed due to inadequate demolition procedures.

Officials did not respond Tuesday to a request for information about any charges that may have been filed against the subcontractor. Additional details about the subcontractor were unavailable.

Fine, Additional Charge

In court, English Prestige Builders was fined $75,000 for the death of the worker and $25,000 for the injury to the other worker, authorities said. The fine was imposed by Justice of the Peace Eileen Walker of the Ontario Court of Justice.

In addition to the fine, the court imposed a 25 percent victim fine surcharge, as required by the Provincial Offences Act. The surcharge is credited to a special provincial government fund to assist victims of crime.
