Paint Shop Tax Fraud Nets 8-Year Term

The owner of an auto paint and repair shop will spend eight years behind bars after stiffing the state of South Dakota on sales tax returns.

Richard W. Guthmiller, 36, owner and operator of 605 Collision & Custom Paint in Rapid City, was sentenced to eight years in state prison, ordered to pay $9,169.82 in restitution, and fined $8,000, in addition to fees and court costs, Attorney General Marty Jackley and Department of Revenue Secretary Andy Gerlach announced Friday (April 26).

The owner of a custom paint and auto repair shop in South Dakota was convicted of eight felony counts of fraudulent sales tax returns.

Guthmiller filed eight returns between February 2008 and March 2011 stating he owed no sales tax, the Attorney General's office said.

8 Felony Counts

He was convicted by a Pennington County jury in February of eight counts of making false or fraudulent sales tax returns in attempting to defeat or evade sales tax in violation of SDCL 10-45-48.1(1).

Each count is a class 6 felony, which carries a maximum penalty of two years imprisonment in the state penitentiary and/or a fine of $4,000.

The case was investigated by the South Dakota Department of Revenue Investigative Services Bureau, audited by the Department's Audit Division and was prosecuted by the Attorney General's Office.
