Quart of Paint May Cost Amazon $78K

The Federal Aviation Administration is proposing a US$78,000 (57,298 euro) civil penalty against Amazon Fulfillment Services of North Las Vegas, Nev., for allegedly violating U.S. Department of Transportation Hazardous Materials Regulations.

The FAA alleges that on Aug. 29, 2013, Amazon Fulfillment Services shipped a quart of high-gloss enamel paint on a FedEx Corp. aircraft from Lexington, Ky., to Corpus Christi, Texas, where workers discovered that leaking paint had soaked through the shipping box.

Paint is considered to be a Hazard Class 3 Flammable Liquid.

Investigators determined the shipment was not accompanied by shipping papers to indicate the hazardous nature of its contents and it was not marked, labeled or packed in accordance with the Hazardous Materials Regulations. The box also contained no hazardous material inner packing, such as inserts or absorbent materials. Finally, the package failed to protect against a release of hazardous material into the environment.

Amazon did not respond to Air Cargo World's request to comment on the penalty.

Amazon Fulfillment Services has 30 days from the receipt of the FAA's enforcement letter to respond to the agency.

A leaking quart of Hazard Class 3 Flammable Liquid—otherwise known as high-gloss enamel—has left a costly mess for Amazon Fulfillment Services.

The Federal Aviation Administration (FAA) is proposing a $78,000 civil penalty against Amazon, of North Las Vegas, NV, for allegedly violating U.S. Department of Transportation Hazardous Materials Regulations.

Amazon Fulfillment Services (also known as Fulfillment by Amazon) stores, ships and offers customer service for third-party products from a network of locations nationwide.

The FAA alleges that on Aug. 29, 2013, the mega-fulfillment network shipped a quart of high-gloss enamel paint on a FedEx Corp. aircraft from Lexington, KY, to Corpus Christi, TX.

When the package arrived, workers discovered that leaking paint had soaked through the shipping box.

Paint is considered a Hazard Class 3 Flammable Liquid.

Upon further investigation, inspectors then determined that the package lacked "shipping papers to indicate the hazardous nature of its contents and [that] it was not marked, labeled or packed in accordance with the Hazardous Materials Regulations," the FAA announced.

The box also contained no inner packing, such as inserts or absorbent materials, that should accompany hazardous materials, the agency said.

The FAA said the enamel, considered a Hazard Class 3 Flammable Liquid, was not secured properly for shipping and lacked appropriate shipping papers.

Finally, the FAA said, the package "failed to protect against a release of hazardous material into the environment under normal transportation conditions."

Next Steps

With Fulfillment by Amazon, third-party vendors warehouse their products in Amazon's fulfillment centers; Amazon then packs, ships and provides customer service for those products.

Amazon Fulfillment Services has 30 days from the receipt of the FAA's enforcement letter to respond to the agency.

Parent company Amazon Inc. did not respond Thursday (Feb. 13) to a request for comment.

This is why we don’t ship by air. I’m curious what paint product it was and if Amazon will make the effort to get up to speed on this or if they’ll evaluate what they ship and stop shipping certain products.

We ship paint offshore in emergency only, the paperwork, packaging and general grief along with the exorbitant cost make this an option of last resort, and that is only with low VOC, high solids materials, so what it would be like to legitimately ship high VOC enamel, probably wouldn't get past the first stage risk assessment!

Amazon should consider themselves lucky. Fedex and UPS have had transportation specialists on board for over 25 years, knowledgeable in 49 CFR regulations covering transportation of hazardous materials. I am aware of 2 shippers that have done time in prison for willfully violating transportation regulations, (underscore "willfully". Amazon dodged a bullet.
